    This guide explains who handles SASSA appeals, exact deadlines, what to submit, how to appeal SRD R350/R370 online, and what to do if an appeal is declined with official forms and legal timelines. The decision‑maker is the Independent Tribunal for Social Assistance Appeals (ITSAA), established under the Social Assistance Act and the Appeals Regulations (2022).

    What is a SASSA appeal? (and how ITSAA fits in)

    An appeal asks an independent tribunal to reassess SASSA’s decision. The legal basis and timelines sit in the Appeals Regulations (31 May 2022). For medically related grants (e.g., Disability), the tribunal may order an independent medical exam and set sub‑deadlines.

    SASSA appeal process: choose the right path

    There are two tracks one for SRD, and one for permanent grants.

    Track A – SRD (R350/R370) appeals online

    1. Check the decline reason on your SRD status.
    2. Lodge your appeal on the official SRD appeals platform within 90 days of the decision.
    3. What evidence can you use? After the Jan 2025 High Court ruling, SRD appeals may rely on new information (the court deleted “not” from Reg 6(c)).
    4. Decision window: ITSAA must finalise within 90 days and notify you electronically.
    5. If approved: SASSA must implement within 30 days of getting the tribunal decision.

    Why SRD appeals are month‑by‑month: SRD is assessed on a monthly cycle, and the regulations refer to appeals against each decision so you appeal each declined month you dispute (inference from Reg 6(a) “decision” and monthly assessments).

    Track B – Permanent grant appeals (Old Age, Disability, Child Support, Foster, Care‑Dependency, Grant‑in‑Aid, War Veteran)

    1. Complete Form 1: Lodging of an Appeal (attach your ID and SASSA decision).
    2. Submit via a SASSA office (they must assist and forward to ITSAA within 15 days) or directly to ITSAA using the contact details on the form. GOVERNMENT GAZETTE, 31 May 2022
    3. Missed the 90 days? Apply for condonation with Form 2 (explain “good cause”).
    4. ITSAA may request extra information or order an independent medical exam with 15–30‑day sub‑deadlines.
    5. Decision in 90 days; SASSA implements within 30 days.

    How to appeal the SASSA SRD R350/R370 grant (step‑by‑step)

    1. Identify the reason for the decline (status check).
    2. Go to the official SRD appeals portal (Department of Social Development/ITSAA managed).
    3. Log in with ID and cellphone (receive an OTP).
    4. Select the month you are appealing (appeals are per decision/month).
    5. State your grounds and submit.
    6. Check messages for the outcome; the Tribunal must decide within 90 days.

    2025 update: The High Court struck down the SRD rule that blocked new evidence at appeal, so you may include new information relevant to the month you’re appealing.

    Can a SASSA appeal be declined? (reasons & next steps)

    Yes. Common outcomes include:

    • SRD: evidence still shows income above the threshold, conflicting bank/home affairs data, duplicate benefits, or missing/incorrect details. (Monthly decisions can differ.) If you still disagree after the appeal, the next step is judicial review in the High Court under PAJA – generally within 180 days after exhausting internal remedies.
    • Permanent grants: incomplete Form 1, no condonation for a late appeal, insufficient medical proof or failure to respond to the tribunal’s information requests. (The tribunal can still request further information or order a medical re‑assessment.)

    Judicial review basics: PAJA requires filing without unreasonable delay and no later than 180 days after internal remedies (the appeal) are finished courts can extend this in the interests of justice. This is legal process get advice before going to court.
