South Africa’s asylum application process has changed after a Constitutional Court ruling required the Department of Home Affairs to remove a procedural barrier affecting people who entered the country irregularly or delayed applying for asylum. Home Affairs issued an operational directive to implement the 7 July 2026 judgment, meaning people who present themselves at refugee reception offices and indicate that they want to seek asylum must be allowed to lodge an application. The change does not automatically grant refugee status, citizenship or legal status, and every asylum claim must still be assessed.
The directive has led to public criticism, increased attention on refugee reception offices and what Home Affairs describes as a coordinated disinformation campaign about what the Constitutional Court actually decided.
Home Affairs said on 7 October that it would refer the alleged disinformation campaign to the Electoral Commission of South Africa for further action under its newly published Code of Conduct on Countering Disinformation.
Here is what has changed, what has not changed and what the new asylum rules mean.

Why Did South Africa’s Asylum Rules Change?
The changes were introduced following a Constitutional Court judgment concerning provisions of the Refugees Act and the processing of asylum applications.
The case involved the Scalabrini Centre of Cape Town. Home Affairs said it opposed the litigation but is constitutionally required to comply with the final judgment.
The department subsequently issued an operational directive to implement the ruling.
Home Affairs has stressed that the change was not independently initiated by the department or the Minister of Home Affairs.
The department said claims suggesting otherwise formed part of the misinformation it is now challenging.
What Was The Good Cause Interview?
One of the central issues is the good cause process that previously affected some people who entered or remained in South Africa irregularly.
Home Affairs Deputy Director General for Operations Thulani Mavuso explained that a person who had entered the country unlawfully previously had to provide reasons for entering or remaining in South Africa illegally before proceeding with an asylum application.
Following the Constitutional Court judgment, that procedural requirement can no longer prevent a person from lodging an asylum claim.
Mavuso said the relevant circumstances can instead be considered as part of the asylum application itself.
This changes access to the application process. It does not determine whether an applicant ultimately qualifies for protection.
Who Can Now Lodge An Asylum Application?
Under the operational directive, refugee reception offices must receive people who present themselves and indicate that they want to apply for asylum.
According to Mavuso, this includes people who:
• Entered South Africa unlawfully
• Entered somewhere other than an official port of entry
• Did not declare an intention to seek asylum at a port of entry
• Do not hold a visa
• Did not report to a refugee reception office within five days of entering South Africa
These circumstances can no longer, on their own, prevent someone from presenting an asylum claim.
Officials must instead receive the application and assess whether the person qualifies for protection.
Does This Mean Everyone Who Applies Gets Asylum?
No. This is one of the main distinctions Home Affairs has sought to clarify following public reaction to the directive.
Being allowed to submit an asylum application is not the same as being granted asylum or recognised as a refugee.
Mavuso said asylum applications continue to undergo an assessment process involving interviews and consideration of the applicant’s individual circumstances.
Officials can also consider information about conditions in an applicant’s country of origin when assessing whether a claim is credible.
The applicant must ultimately establish that they qualify for protection.
If an application is rejected and the applicant no longer has status in South Africa, Mavuso said the person must leave voluntarily or could face deportation.
Does The Ruling Give Undocumented Foreign Nationals Legal Status?
No. Home Affairs has specifically rejected claims that the Constitutional Court judgment amounts to blanket legalisation of undocumented foreign nationals.
The ruling allows affected people to access the asylum application process despite procedural issues relating to how they entered or remained in South Africa.
Their individual asylum applications must still be assessed.
Home Affairs has also rejected claims that the judgment automatically grants citizenship to asylum seekers.
The department said these interpretations misrepresent the effect of the Constitutional Court judgment.
Why Is Home Affairs Warning That The System Could Be Overwhelmed?
While Home Affairs is implementing the ruling, its own officials have acknowledged that it could place additional pressure on the asylum system.
Mavuso warned that refugee reception offices could experience a significant increase in applications because people cannot be prevented from lodging claims simply because of the procedural barriers affected by the judgment.
He said Home Affairs could have to consider longer operating hours and increased staffing to deal with demand.
Mavuso also raised concerns that people who are primarily economic migrants could attempt to enter the asylum process alongside people genuinely seeking protection.
However, being permitted to lodge a claim does not require Home Affairs to approve it.
The assessment process remains the mechanism through which officials determine whether an individual qualifies for protection.
Why Has The Directive Attracted Public Attention?
The directive has prompted debate about immigration, the asylum system and the capacity of Home Affairs to process applications.
Questions have been raised about the number of applications the department could receive, how long applications could take to process, the criteria used to assess claims and the capacity of refugee reception offices.
Concerns have also emerged around tensions at refugee reception centres.
On 6 October, asylum seekers waiting at a refugee reception centre in Durban were confronted by a group of about 15 people. Some members of the group were reported to be carrying sticks or knobkerries.
Police moved the group away from the parking area after people waiting to apply for asylum were confronted.
The incident occurred as people queued to access the asylum application process following the implementation of the new arrangements.
Why Is Home Affairs Referring The Matter To The IEC?
Home Affairs says false information about the Constitutional Court judgment and its operational directive is circulating online.
The department specifically rejected claims that the decision to suspend good cause interviews originated with the Minister of Home Affairs or the department itself.
It also rejected claims that the judgment automatically grants asylum seekers citizenship or provides blanket legalisation to foreign nationals.
Home Affairs said it would refer the alleged disinformation campaign to the Electoral Commission of South Africa under the newly published Code of Conduct on Countering Disinformation.
The department has also urged South Africans to verify information before sharing claims about asylum applications and the Constitutional Court ruling.
What This Means For Gauteng Residents
The Constitutional Court ruling and Home Affairs directive apply nationally, including in Gauteng.
For Gauteng residents, the key distinction is between being allowed to enter the asylum application process and being granted asylum.
A person who entered South Africa irregularly can now present themselves at a refugee reception office and seek to lodge an asylum application without first being excluded because of the procedural barriers affected by the Constitutional Court judgment.
That person does not automatically become a refugee or citizen simply by lodging an application.
Home Affairs must still assess the individual claim to determine whether the applicant qualifies for protection.
Residents should therefore distinguish between access to the asylum system and the outcome of an asylum application when encountering claims about the directive online.
Frequently Asked Questions
What Changed With South Africa’s Asylum Rules?
People who entered South Africa irregularly or failed to meet certain previous procedural requirements can no longer be prevented from lodging an asylum application solely on those grounds. Their claims must still be assessed.
Can An Undocumented Person Apply For Asylum In South Africa?
Under the operational directive described by Home Affairs, a person who presents themselves at a refugee reception office and indicates that they want to seek asylum must be allowed to lodge an application, including in circumstances involving irregular entry. The application must still be assessed.
Does Applying For Asylum Mean Someone Automatically Becomes A Refugee?
No. Lodging an asylum application and being granted refugee protection are separate stages. Home Affairs must assess whether an applicant qualifies for protection.
Does The Constitutional Court Judgment Give Asylum Seekers Citizenship?
No. Home Affairs has explicitly rejected this claim. The judgment does not automatically grant citizenship or provide blanket legalisation of foreign nationals.
Why Is Home Affairs Taking The Issue To The IEC?
Home Affairs says a coordinated disinformation campaign is misrepresenting the origin and effect of the Constitutional Court judgment and its operational directive. The department said it would refer the matter to the IEC under the Code of Conduct on Countering Disinformation.
What Happens Next
Home Affairs must continue implementing the Constitutional Court judgment while processing asylum applications under the revised procedure.
The department could also face increased pressure at refugee reception offices if application numbers rise, with officials indicating that additional staffing or longer operating hours may have to be considered.
The IEC referral creates a separate process concerning the alleged disinformation campaign surrounding the directive.
For asylum applicants, the central change is access to the process. Irregular entry or failure to comply with certain previous procedural requirements can no longer automatically prevent a claim from being lodged.
For the public, the distinction remains important. The Constitutional Court judgment changed how affected asylum claims enter the system. It did not guarantee that those claims would succeed.
